SRA Supports EAB Decision to Hold Public Hearing on SIA Contaminated Landfill

Shawnigan Lake, BC: On November 27th, 2013, Environmental Appeal Board Chair Mr. Alan Andison ruled that the matter pertaining to the Environmental Management Act regarding an appeal to Permit PR-105809 Cobble Hill Holding Ltd aka South Island Aggregates would be conducted as a public hearing over a four-week period in March 2014.

Five appellants will be heard which include the Shawnigan Residents Association represented by Mr. Sean Hern and Mr. Robert Anderson QC Farris LLP, the Cowichan Valley Regional District, Mr. and Mrs. John and Lois Hayes, Mr. Ronald Witherspoon and Mr. Richard Sanders who are opposing the SIA permit. These appeals will be heard together, Mr. Alexander of Cox Taylor will be representing SIA.

It is expected that between 30-35 witnesses will be called during this four-week hearing. As well, the board ruled that the appellants must submit documents for prior to the hearing by January 30th, 2014 and despite opposition from SIA's counsel having issues with delivering the permit holders documents, severing the hearing to have the environmental arguments heard first, and expediting the hearing. SIA must deliver all of their material no later than February 17, 2014 to the appellants listed above.

Hearing dates will be held in Victoria over the following dates. March 3 - 7, 2014 March 10 - 14, 2014 March 24 - 28, 2014 March 31 - April 4, 2014.

The Shawnigan Residents Association is pleased that the board has ruled to have this matter heard publicly to allow for cross-examination of witnesses. We remain confident that our case has strong merit and the CCH/SIA permit remains a threat to the health and safety of the people of Shawnigan Lake.

The SRA believes in swimmable, drinkable and livable water and we plan to continue our fight for this cause. We also are pleased to be working closely with the CVRD to ensure as successful outcome in the public's best interest.
